Junta to Legalise Majority of Illegal Properties of Gil Era

Diario Sur - 2005-05-17

The Public Works Councillor, Concepción Gutiérrez from Málaga, announced yesterday that around 80% of the housing built during the Gil era, which violated the PGOU of 1986, will be legalised. Only the constructions that have been built on ground deemed unsuitable for building (constituting 4.4 million squared metres on which 3,177 apartments have been built) and those developments that have ruined green areas will remain outside of legislation and will await sentences from the courts of law.

The PGOU has a large chapter dedicated to the problem that is illegal buildings, with specific emphasis on the disastrous town planning management since 1994, which has been operating on a non-existent town plan causing the number of houses with illegal licences to rise to 30,000.

The editors of the new PGOU have confirmed that the document tries to establish a town plan that is coherent and that conforms to the general interests of the town while at the same time it is pointed out that building development that does not comply with the new plan will not be approved.

Concepción Gutiérrez believes that, with this new plan, Marbella has a great chance of re-establishing the condition of their excellent town. The councillor affirmed that there would be a complete turnaround in the town in order to regain legality.

As for the declarations of the Mayor of Marbella, Marisol Yague, regarding her denial of the new PGOU – she thinks that they have invaded municipal rights and that they have not spared a thought for Marbella society in the draft – Gutiérrez has responded by saying she hopes the Mayor can reflect on this and eventually learn to approve of the new plan.
