The Court handed down rulings to suspend two planning permission licences granted by the Town Council, affecting a total of 386 homes. The permits were granted on 19th March and 14th May in the year 2003. The Court changed its criteria some months ago regarding these precautionary suspensions.
Including the two aforementioned suspensions, 38 licences granted by the Marbella Town Hall have been suspended by the Andalucian Court (out of a total of 200 cases contested by the Council).
Planning permission granted to a company called OBARINSA SL was the first to get suspended. This was for the construction of 107 apartments, parking lots and a communal area in Cortijo Los Monteros in Marbella. The second suspension was for planning permission on 279 apartments in the Rio Real area.
One company that is affected by these judicial decisions is NAVIRO SL, a subsidiary of the development group Avila Rojas. NAVIRO SL have already appealed for the building to go ahead in the Banana Beach area.
