Ávila Rojas Appeal Sentence On Banana Beach

The company Naviri Inmobiliaria 2000 S.L., a subsidiary of the Ávila Rojas group, have made an appeal to the Supreme Court against the sentence handed down on the 15th April to cancel licences to build three buildings (consisting of more than 240 apartments, business premises and garages) in Banana Beach, an area classified by the Town Master Plan (PGOU) as a green area and which is situated on the first line beach.

The developer thinks the judicial review proposed by the Junta is untimely. The building licences that are currently being annulled by the high court were granted and endorsed on the 9th September and the 2nd October.

 Ávila Rojas’ defence will show that the building permits were granted before the publication of the PGOU of 1986. The Prosecutor’s Office believe that before this was carried out, the only valid plan dated back to 1968. The developer is waiting for the said evidence to be acknowledged and for the decision made by the High Court to be revoked.

The verdict has filled 240 families with uncertainty; these have all acquired one of the apartments in the said area and many have already inhabited theirs.
