“Hotel Guadalpin Banus” – Only a few metres from the beach, this hotel can only be described as a large mass of cement. It was built despite two suspension orders handed down by a court and the Town Council in Marbella.
This project, whcih is involved with the companies AIFOS and ZIUR Construction, was granted planning permission in 2001. The permit was suspended by order of the Town Hall on August 13th 2003. Among the different judicial proceedings, on December 4th 2003, a judge ordered that the work be stopped, effective from the following day. The judge verified that the developers broke town planning rules and furthermore, the construction did not comply with the PGOU of 1986 (town planning laws).
The developers presented a detailed report in which they insisted it had been obligatory that they carry out certain jobs for safety reasons. However, those who initially complained produced further evidence for the court in the form of a video recording and a legal document in which it suggests the developers did not carry out safety procedures but instead built three storeys of the building! They consider these events as fraud and insist that they are helpless against what they can only call a violation of their rights.
