History is repeating itself. The politics of fait accompli are rampant in Marbella again. The Supreme Court of Andalucía have cancelled a permit to construct three buildings (for more than 240 apartments, business premises and garages) in an area classified by the PGOU of 1986 as a green area. A judge terminated the work in 2001 but due to a further hearing in the Provincial Court in Málaga, the work continued. The “Banana Beach” apartments, located at the west entrance to Marbella on the first line beach, have been inhabited for years now. The Town Hall have announced that they will present an appeal at the Supreme Court to bring to an end a case that has been stagnant since 2001. The hearing will be held in the criminal court in Málaga.
