High Court Annuls Second Illegal Building Permit

At the end of May, the Supreme Court of Justice in Andalusia (TSJA) revoked the building licence of Banana Beach which was for the the construction of three buildings on ground classed as a green area. Now the Andalusian Court has decided to cancel another, which was approved six years beforehand during the GIL era.

 

The licence in question was for a building called “Parquesol”, located in the centre of town. It was granted to the company “Lardea” for the  construction of 132 apartments (already finished and inhabited) in an area that does not comply with the valid PGOU (town planning rules).

 

The town’s government confirmed yesterday that they were extremely surprised at this annulment. According to the Marbella Town Hall however, it was clear that the work was illegal right from the very start. Isabel García Marcos, deputy Mayor, believes this has come at the wrong time and that the High Court should assess if such drastic action was deserved.
