The developers are retaliating. Representatives from NAVIRO INMOBILIARIA 2000 S.L. (subsidiary of ÁVILA ROJAS) announced yesterday that they were going to put in a claim for damages against the Junta (Andalucian Council) for terminating building work in Las Lomas de Río Real.
According to the representatives of NAVIRO, this termination order ended up being lifted by the TSJA (High Court of Andalucia). The company is now claiming damages of 5.1 million. They are also preparing claims for the same reasons against the autonomous government for every single termination NAVIRO believes to have been unnecessary.
The Junta intervened in these two works the same way in which they have for various cases once they hear the licence was granted by the former government and violates the current town planning laws (PGOU of 1986). However, the courts are not going to get involved with building terminations until the town planning issue has been dealt with.
