Government Disallows Building Licence For 22 Semi-Detached Houses In Las Cancelas

Today, the Marbella Town Hall has announced that the Andalucian Council will reject the building licence requested by the company CONSTRUCCIONES GARRIVAS S.L. on 12th of February last, for the construction of 22 single-family semi-detached homes in Las Cancelas of San Miguel. Isabel García Marcos (Acting Mayor) confirmed that the government has made this decision because the project does not comply with the PGOU of 1986. The land is in fact categorised as potential public sports ground.

 

García Marcos added that the Andalucian Council intends on submitting the file to the Department of Town Planning Discipline so that appropriate action can be taken and the work can be terminated.

 

MUNICIPAL AUTHORISATION

The Acting Mayor has also denied that the government had authorised CONSTRUCCIONES GARRIVAS S.L. to start preparations on the site. In the middle of February, the Ecology group announced that the developers had already begun levelling the ground, cleaning out and cutting the trees on the plot of land in Las Cancelas of San Miguel and expressed their fear that the building work was imminent.

 

CRITICISM

The Ecology group also condemned the Marbella government for having “deaf ears” and ignoring the agreements that would have been reached by the previous governing body. They state that with the previous government, the developers had claimed that they had already worked around that particular area, building a development of 20 semi-detached Mediterranean-style chalets on 4000 square feet of land but that the legal services from the Provincial Town Planning Committee had just begun to contest the work at the time they brought up the current complaint at the High Court of Justice in Andalucia.

 

Despite this controversy, the Marbella government has declared that while the new PGOU is being drafted, the Town Hall is following the only valid PGOU, which is from 1986.
