The Appeals Court no. 2 in Málaga has ordered the property developing company AIFOS to pay €2,100 in compensation to a couple for the delay in handing over a property in one of the developments in Añoreta Golf in Rincón de la Victoria. The sentence is based on the fact that by not complying with the predicted time-span, the property company has caused financial damage to these clients, who in fact had to rent out a house last March. For this reason, the judge believes that AIFOS should pay the rent money the plaintiffs had to pay – €420. The sentence does not take into account the deposit – €840 – on the basis that this will be returned to the tenants afterwards.
At the moment, according to the clients’ lawyer, the developer will have to take responsibility for these rental payments up until July.
The couple signed a purchase contract for a property in the development Lomas del Golf with AIFOS in November 2001. In the clauses, it was specified that work would be finished 20 months from the signing date, but works had not yet begun last March.
